If a gym wants to hire a female trainer to lead a female only class it is allowed to only review female candidates, for instance.

Either this person stumbled in off the street and gotten the job or the client themselves just haven't been working long enough to know consequences of their actions.HR will have a field day but if they employ people like this that are unprofessional and sexist so easily, just have to laugh at how much HR really helps its own company.

    Makes me wonder what would happen if the prospect were a woman now.Still seems like a lawsuit would be brought up sooner than later. My head is spinning just thinking of what was going through their mind sending the email.

    NCC1701-Enterprise 48m ago So if the company is less than 15 employees they can legally do this. Also in some situations it is legal to discriminate based on gender. Regardless a report to the DOL isn't going to cost you anything so go for it and if this isn't one of those situations where it is legal they will get a hefty fine.

    You can talk to a lawyer but there isn't likely going to much in the way of damages to make it worthwhile. Even if the law in your state allows for punitive damages it isn't going to add up to much and likely will cost you more in legal fees than you will win, but still worth a free consult.
