When the residents in the story below decided they had to make the house more accessible since one of them is now a wheelchair user, they probably knew there would be challenges. Wheelchair users face accessibility challenges every single day.

However, they did not expect to face this much pushback from the HOA, especially not for something as simple as a wheelchair ramp.

So they didn't even think about asking for permission to install one when they realized it was needed. Then, they got a notice from the HOA demanding the ramp's removal, claiming it "disrupts architectural harmony". Surely, they could not be serious, right? This led the resident to file a formal request for the ramp, complete with a doctor's note and even an offer to paint the rail to match the precious "architectural harmony".

Still, the HOA denied the request and even added daily fines. That was the final straw for the residents, who couldn't care less about the neighborhood aesthetic. They hired a lawyer and filed a lawsuit against the HOA.

    thinksying Your HOA deserves to be sued. Any neighbor that complains should actually go to board meetings and campaign to join the board. The HOA is violating ADA laws which is much more important than aesthetics.

    Automatic-Truth-4220 I think that you should sue the HOA for discrimination against the disabled and explained to them. explain to the courts that they are interfering with your right constitutional right to be able to come and go on your own and maintain Independence with ridiculous rules and honestly I think you could win that lawsuit easily but you will have to fight him in court

    Dorzack I am willing to bet the HOA board is doing this without working with a management company or a law firm. Either one should tell them they are way over stepping and opening themselves up to losing in court. Hopefully a sternly written letter from your lawyer will get them to notify their lawyer, and that lawyer will tell them, "H, no, you are wrong, and drop those fines." NTA - you are not being litigious, the HOA is breaking the law.
