"AITAH for telling husbands family he deserves/is legally entitled to his inheritance"

This is a very weird situation. I may have become a bh over it, but hear me out. My husband and his brother are going through probate.
  • 03
His brother lives in the parent's house and he has no plans on moving which he has vocalized. Yes husband can force a sale but he's trying to be nice and
  • 04
make everyone happy. Anyway, everything is supposed to be split 50/50 per the will, but on top of that, the brother was made sole beneficiary on the
  • 05
stocks this is very important info, remember this. So therefore, the stocks are his and my husband can't touch them.
  • 06
My husband has been asking for his half of the house and the bank account like he's legally entitled to. Again, he can't touch the stocks. He offered to have
  • 07
his brother buy him out for his half of the house, like any normal person would. Here's where it gets weird.
  • 08
The brother says he's willing to buy my husband out, slowly. Over the course of many years. He does not want to take too much out of the stocks at once to pay
  • 09
off my husband for his half of the house because of taxes. The COUSIN got involved and tried being the middle man because the brothers
  • 10
were disagreeing. He told my husband, "what do you even need all the money for right away anyway?" This is where I come in.
  • 11
My husband was hurt so I stepped in and started yelling. I said it's absolutely asinine that the brother is sitting on hundreds of thousands of dollars in
  • 12
stocks that my husband can't touch, and yet he refuses to buy out my husband out immediately for his half of the house. The taxes with the stocks are not my husbands problem.
  • 13
The cousin called me money hungry and said that I'm the problem in this family. He said the family always helped eachother out before this and that I'm corrupting
  • 14
my husband, basically. In my opinion, the family has no issue swing my husband over. That's what I'm seeing. I've never heard of a deal where one brother pays the
  • 15
other brothers back slowly over the course of many years after probate when he has the money to buy them out now. But on top of that, I am ped the cousin got
  • 16
involved and insulted me for standing up for my husband. I have no intention of talking to him ever again. Thoughts?

    INHERITANCE LAW

CandiNikaSho NTA. Your husband is legally entitled to his inheritance, and it's unfair for his brother to drag out payments when he has the means to settle now.
  • 19
The cousin overstepped by insulting you―you were right to defend your husband. The family is prioritizing the brother's convenience over fairness. Stick to your stance.

Ok-Wonder851 Just hire an attorney and they will get it real fast
  • 21
65inchestall OP Yeah we were hoping not to have to do that but you're right
  • 22
Str8goodz30 NTA. In all honesty, if they were to split everything 50/50, your husband should get 50% off everything, including the value of the stocks.
  • 23
65inchestall OP Yes if we're talking "morally" then absolutely but the stocks legally my husband can't touch as far as we know
  • 24
StrangledInMoonlight Y'all need to get a lawyer. Your husband hasn't been given access to or the contents of the bank account he was willed. If brother had access he could be taking money from it.
  • 25
It's worrisome brother isn't giving the bank account, wants years to buy out half the house, and won't sell the stocks. There's a chance those stocks are gone, and so is the bank account $$.
  • 26
65inchestall OP Bank account is frozen in probate. Stocks are brothers and from what we've read, he was made beneficiary so husband can't touch them.

AlternativeDue 1958 Just remember that your bil is the reason you're going to have to get a lawyer involved.
