How do I tell my roommate she needs to move out after she adopted a dog without asking me?

Eviction notice with DEPARTMENT OF HOUSING EVICTION 'She'll be held responsible for any further damage to [my] home.' VACATE WILL RESULT IN LE OLDINGS, ATTORNEY FEES AND PENALTY DAMAGES. STS, Section 1752 Civil Code

I (26F) own a condo in Phoenix. My roommate "Kelly" (28F) has been renting a room from me for about two years.
  • 03
Things have been mostly fine until last month. Kelly has been talking about wanting a dog for a while.
  • 04
I told her multiple times that I'm not comfortable with a dog in my condo. I have severe allergies to pet dander and I also travel for work frequently.
  • 05
I was clear from the beginning that no pets were allowed. Three weeks ago I came home from a work trip and there was a dog in my living room.
  • 06
A full grown German Shepherd. Kelly said she "fell in love" with him at a rescue event and adopted him on the spot.

She said she thought I'd "come around" once I met him. I immediately told her this wasn't okay and she needed to return the dog or rehome him.
  • 09
She said she already paid the adoption fee and did all the paperwork, and that it would be "cruel" to give him back.
  • 10
She promised she'd keep him in her room and I'd barely notice. That lasted two days.
  • 11
The dog has full run of the condo. He's destroyed two pairs of my shoes, scratched up my hardwood floors, and barks constantly when Kelly's at work.

My allergies have been terrible - I'm taking Benadryl daily just to function. I've asked her repeatedly to find somewhere else for the dog.
  • 14
She keeps saying she's "working on it" but nothing changes. Yesterday I found out she's been posting on social media about "her dog" and her apartment, acting like she owns the place.
  • 15
I told her last night that if the dog isn't gone in two weeks, she needs to move out.
  • 16
She burst into tears and said I'm being heartless, that she's already bonded with the dog and can't give him up.
  • 17
She said she can't afford to move out right now and I'm basically making her choose between her "baby" and having a place to live.
  • 18
Now she's turned some of our mutual friends against me saying I'm trying to make her homeless over a dog.
  • 19
But this is MY condo that I own. She violated a clear rule and now she's acting like I'm the bad guy.
  • 20
How do I actually get her to move out? Do I need to do a formal eviction?
  • 21
I've never dealt with this before and I don't want to be cruel but I also can't live like this.
  • 22
Odd-Occasion-3528 What makes this worse is she keeps guilt-tripping me about the dog. Saying things like "He was in a shelter, he deserves a home" and "I saved his life, I can't just abandon him."
  • 23
I feel terrible but also I TOLD her no pets before she even moved in. This wasn't a surprise rule I made up. She agreed to it and then completely ignored it.
  • 24
BigConfidence1563 This is how you tell her: You hand her notice of eviction or whatever that is in country you live in and let her know that she has x amount of time to either rehome the dog or she is getting evicted.
  • 25
Will any of them chip in to fix the damages? No? Did they pay for your condo? No? Right, so they can all take the off and preferably dog with them. You don't need friends that are so keen on virtue signaling when it's not their property and financial burden.

and would find I would be out which adoption centre she got him from and let them know she adopted while her landlord (you) have not agreed to it and are asking for the dog to be removed from her because she lied. As far as I am aware most ponds/shelters will check prior for you getting pet if you can actually have it.
  • 27
Edit to add: I would find the post with dog and apartment and make very clear comment saying that she ain't owning sh* because it's your house and you have not agreed to a dog and you remind her that she has to rehome the dog or she is being evicted.
  • 28
Brilliant Jaded8402 I would let the shelter know that she didn't have her landlords permission before adopting the dog. The ones by me will take the dog back because checking with your landlord if you have one is part of the adoption agreement. Not doing so can actually have you banned from adopting from them again.

Quick-Possession-245 Just give her an eviction notice. Ignore the guilt trips. She KNEW that dogs were not okay. Evict her on the basis of a lease violation. Check the state laws. In many cases, if the owner lives in the house the laws lean more toward the owner than if you are a commercial landlord.

Evict her and demand court costs. I am really pro-tenant. But she went over the top here. She is making you miserable and unwell in your own home and taking no ownership of the situation. You screwed up by not taking action right away, but stop giving her time.

Beneficial-Sort4795 My roommate/cousin showed up from a visit with her (shitty useless) parents with a kitten. She was broke, allergic and ignoring the lease we both signed that said 'no pets'. Even without all that, I've never

wanted a live in cat. I looked at her moron father and told him to take the kitten right on back to his car. There was a signed lease and I wasn't getting kicked out of my home because he was too stupid to check with the actual person paying the rent and gave

her a kitten she couldn't even afford. My cousin cried and locked herself in the bathroom for hours. I could give a damn. I sent him off with the kitten and told him don't ever try to make rules in my house again.
  • 34
You need to ignore the guilting and crying and foolishness and hold firm. She violated the lease and her and the dog need to go for the lying and guilt trip alone. I don't know what lie she told but you typically need to say you own the home before you can
  • 35
adopt a pet without them checking with your landlord on a rental. Get ahold of the adoption place and they'll likely repo the dog cause of her lie. Assuming she didn't lie and get him from someone she knows.
  • 36
Tell her she can go willingly now or you can formally evict her and that will stay on her record. And you won't have anything nice to say as a reference for a new place. She violated the lease and she's out, end of story. And she'll be held responsible for any further damage to your home. Take pictures, keep receipts.

The mutual friends- tell them you're glad they're onboard and you'll let Kelly know she's free to move in with them and take Cujo with her. They'll enjoy his taste in shoes. Bet they real quick when their expensive shit is on the line.
