Boss bombards mostly-remote employee with 5 AM screenshot demanding 5 days/week in the office: 'It's an hour drive from home'

    Started Aug 2025 at a small, old, family-run business. The job was 4 days remote / 1 day in-person. From Aug-early Jan I only went in 3 times (and it was random coworking spaces). They're opening a new location next month, and I've been going in 1-2 days/week recently while training a new hire. I could run this place, I have ran similar business in the past.
  • Sunday night my boss texted at 10pm to "check my email." I checked at 11pm—nothing. At 5am Monday she sent a screenshot of an email she sent to my company email saying. starting immediately I must be in- office 5 days/week, 9–6.
  • I replied to that email with "since I didn't see this email until the morning of Monday Feb 2nd, I will be working remotely today as normal" We met virtually at noon. I mentioned that I was already planning on asking this, would it work as a compromise (2 days in- office + transition period, or different hours like 7-3). They refused. Offer: cover 50% of parking, still 9-6 M-F, starting Tuesday.
  • It's an hour drive from home. The building is in a large metro area and dos not include parking. My hours has been mon-thurs 9-6 Fri 9-2. It has been adjusted three times to accommodate the owners changing schedule. I have standing commitments on Friday afternoon and Wednesday evening that they are aware of. I'm also pretty sure I was treated as a 1099, not W-2, for 2025. I'm broke and can't just quit.

    Karyn047 You should have either a 1099 or W-2 for 2025. Both were due by 1/31/2026 from employers.

Jan 26th I got an email from him: "My name is x, I am a CPA and I have been contracted by x to prepare the contractor 1099's for 2025. Please complete the attached W9 form and send those forms to me no later than Wed Jan 28th at 9 am. The forms can be emailed to this email address."   • gheiminfantry You should know if you're 1099 or W2, regardless of how they "treat you". Why don't you know the basics about your job?
  • ajzinni Well if they 1099'd you then you have them by the balls because they can't dictate your hours or location as a freelancer. If it gets out of control I would threaten to take them to your states labor board.

  • FIXEDGEARBIKE You're \pretty sure\ you're 1099 and not a W-2 for \last year\?? It's illegal to classify you as a contractor at the end of the year without that agreement in place...you'll owe the government like 25-35% of your entire years income. Also you don't qualify as a 1099 because they're controlling your schedule and you essentially run the place. The IRS LOVES hearing about stuff like this.

  • UpperLeftOriginal Do you have a contract? Have you seen a pay stub? Have they been paying payroll and income taxes? If you're a contractor, they can't control your work hours or how many days you're in office, as long as you are producing the agreed- upon product.
  • psychoplath97 You do not know if you are w2 or 1099? W2- they paid taxes, when you file you most likely get a refund. 1099- they did not pay taxes so when you file you will owe a lot. You should know because if 1099 you would be saving part of every paycheck on anticipation of paying taxes.
  • tconners You think you're 1099? You wanna find that out real fast, cause if you're 1099 and broke and haven't been setting aside money for taxes, tax time isn't going to be fun. There's also a slew of other issues with you being misclassified as 1099.
