My wife and our small 2 kids went on a couple month long visit to our in-laws and we came back last week with a long letter on our door from the neighbor demanding us to pay for $700 for tree trimming in his property.
  • 04
We had several large trees from our yard and there are some branches and leaves that are encroaching on his property. We did not hear from the neighbor before at all and we

are not aware of this situation (this new neighbor moved in a couple months ago and we NEVER had an issue with our old neighbor) since we were out of town. So the neighbor
  • 06
decided to hire a gardener on his own without discussing with us and now he's demanding us to pay for the bill. He also quoted how the tree made his wood discolored and his dog can potentially eat poisonous leaves. It's a mess. What's your take on this?

    – Update: thank you everyone for responding. The general consensus is I am not responsible for the trimming cost. The neighbor also made some outrageous claims about

    1. The tree stained the concrete and it took a number of times to finally clear most of it off.
  • 09
    2. one of the trees is toxic to humans and dogs and dangerous to them if ingested
  • 10
They are planning to get us to pay for their stained concrete and potential medical bills/vet bills

Second update: Wow, did expect so much response. So I just found out the neighbor is actually a lawyer. I think the best thing to do is to also hire a lawyer to draft a letter.

Unusualshrub003 - 1 day ago Man, your new neighbor sounds like he's gonna be FUN! But f'real, don't cave on this. Assert dominance.

lavnyl 1 day ago Some of the answer may vary based on location but in general anything overhanging his property is his responsibility. And of course he can do nothing to have a negative impact on the health of the tree
  • 15
Even if you're responsible for this cost (you're not) then you should have had the opportunity to use your tree guy or to get different quotes. But again this is sort of a moot argument
  • 16
In most places you will not be required to pay. Whether or not you want to help shoulder some of those costs is up to you but the approach taken certain wouldn't motivate me to do so

RockNWood 1 day ago You don't owe him anything. He is responsible for any limbs hanging over the fence onto his side even though it is your tree rooted on your side. You might want to look up the specific state, county or city law that applies, print it off, and hand it to him. Or just ignore him.

encroachment and related mess (this is violating our right to quiet enjoyment of our property) and specifically the areas near the shared fence as a result of the trees. It is very clearly a nuisance and negatively impacts the use and enjoyment of our property."
