Couple sues "mommy influencer" after she secretly films them and posts the video online: 'Our faces are clearly visible in the videos I might add'

We live in a world where people feel entitled to film everything and anything going on around them and post it online. The reality is that there are some things that you don't need to share with the world and, further, thingsthat you shouldn't post about others.

Something about this post reminded me of something in a documentary I was watching last night on Netflix about a recent high-profile missing persons case. Throughout parts of the case, they were showing how "influencers" were farming views by posting video evidence they had relevant, rather than sending it to the authorities, just jeopardizing the investigation. Really just makes you wonder what we have come to as a society, farming clout rather than doing the right thing for the sake of doing the right thing.

  • Really brings to mind the thematic explorations of Nightcrawler starring Jake Gyllenhaal, whose character disturbingly monetizes footage of accidents by invasively intervening before assistance can arrive. There's something chilling to think that your fate could be monetized and broadcast for other people's entertainment and that this is a reality that is already happening. 

    When this couple, who were looking for a place to buy, visited a home for sale that belonged to a local "mommy influencer," they found themselves unsuspectingly recorded in the home with audio, with their conversation then being posted online for the world to see.

    "AITA for threatening to sue a 'mommy' influencer?"

    Flash forward about 4 days and I get a text from one of my friends asking if I'd seen this, with a link to an instagram reel from a local 'mommy' influencer (35F). I click on it and its a security camera video of my husband and I walking through the home on a tour with our realtor, and she's taken all the clips where I was talking about things that I didn't

    like or what I would change, and spliced it up so it looks like I'm being highly critical of her home. The rest of the video is her saying she would never sell to us because we are 'mean and nasty people'. Our faces are clearly visible in the videos I might add.

    My husband drafted up a cease and desist letter yesterday threatening legal action unless she removes the videos and now she's blasting us all over town to kingdom come with her little army of mommy trolls on my husbands law firm social media accounts and my firms webpage (mind you I'm the owner of my firm so it doesnt make a difference for me, but it does for my husband). She hasn't taken down the video yet and we are fully prepared to take her to court if she doesnt.

    My realtor is extremely embarrassed and said that the other realtor is embarrassed as well. Needless to say we are not pursuing her house anymore and are taking a pause while we deal with this. Two of our friends said we should've just tried to ride it out and let it pass because this type of thing always does, but I just could not let her do this. AITA?

    BlueGreen_1956 NTA Show no mercy. People like her continue to do things like that because nobody ever follows through and nails their a to the wall. Secretly recording you could be enough on its own to cause her some major trouble.

    nerdit1000 NTA - influencers need to be held accountable for their fake BS. How toxic can a person be? And to show your faces?? They aren't very bright and should probably consult their own attorney to get a feel for the damage they've caused.

    Chaotic Crashy NTA Take her down! My home is for sale and IT MUST BE DISCLOSED if you even have a ring camera. Cameras throughout the home that were not disclosed to you may not be legal, depending upon where you live. In Florida- it's a huge deal to record within homes for sale and not disclose.

    fuzzy_mic Talk to your husband, but you should sue the realtor, sue the owner, sue the influencer and sue the platform. If the realtor ever said something like "I'll leave you two alone so you can talk" while you toured the house (my realtor said that to me and my wife when we toured a home) there's an explicit statement of privacy that even a one party consent law might have problems with.
