HOA fined me $75 because my trash can was “visible from the street”… 6 hours before trash pickup

Got a letter from my HOA this morning with a photo of my trash can at the end of my driveway. The timestamp on the photo?

8:07 PM. Trash pickup is the next day—like it has been every Tuesday for the past three years.
  • 04
Apparently, putting your trash out the night before is a "violation of neighborhood aesthetic standards."
  • 05
So just to clarify: they want me to wake up at 5 AM, roll it to the curb in complete silence, and hope the garbage truck shows up
  • 06
before the violation patrol does a second photo shoot? I didn't realize I was paying $300/month to get shamed by a suburban paparazzi.

Zealousideal_Gap_553 Your mistake was living in. HOA.

johndoe1625 OP HOA: where you pay hundreds a month to be told your trash has a curfew. It's basically a Netflix subscription to your own suffering.

gorilla_in_my_head What happens if you ignore the HOA?
  • 10
johndoe1625 OP It depends on the HOA and how aggressive they are. Ignoring them can lead to escalating fines, suspension of amenities (like pool access), and in extreme cases, they can place a lien on
  • 11
your property or even initiate foreclosure if fines go unpaid long enough. Some HOAs are chill, others act like a mini government with too much power and not enough chill. Best to at least respond or dispute in writing if you think it's unfair.

hamsterfamily 8pm to 5am is more than six hours. Are there concerns about wild animals? In my area if you put garbage out the night before it will get attacked by crows, raccoons or even bears. So it
  • 14
sounds perfectly normal to have to get up early to put it out. But I take it you haven't had that problem where you are, if you have been leaving it out overnight other times.
  • 15
johndoe1625 OP Fair point on the wildlife — but the issue isn't animals, it's "neighborhood aesthetics." They didn't mention a mess or damage, just that it was visible from the street. Been putting it out at the same time for 3 years without issue. This feels less like prevention and more like pettiness.

Warm-Delivery1418 It would be a shame for anyone to find out that you have trash.
  • 17
johndoe1625 OP HOA really said, "You generate waste? Disgusting. Not in this economy.
  • 18
drowninginidiots If this is the first time in 3 years they've enforced it, and if you can find others in your neighborhood that have been doing the same, then they can't just arbitrarily start enforcing the rule. They would have to at least give you notice
  • 19
that the rule is going to start being enforced. I'd make a complaint to the HOA about the sudden fine. You could get a lawyer involved, but that of course would cost you way more than the $75.
  • 20
johndoe1625 OP Exactly my thinking. If it's truly about enforcement, then they've got to treat it like a policy shift, not a sudden ambush. No prior notice, no neighborhood-wide reminder―just a random fine out of nowhere? Feels more like someone got bored and went on a power trip with a camera.

Cpl4Play6 Tough to feel bad for the plights of people who decide to live in an HOA.
  • 22
johndoe1625 OP Didn't know what I was getting myself into. First home and my real estate agent sold me on the amenities. Sounded great at the time...

lexiconlion 1. Check the bylaws. When I lived with my ex he has an HOA that tried to find him for the garbage cand being put out the night before. I read the bylaws and it said they could be put out after
  • 24
6 PM the night before pick up, and put away by 8 PM day of pick up. He cited the bylaw when he mailed them the violation letter back telling them he wasn't paying it. 2. Most HOAs have a board made up of the homeowners. Get on the board, it's the only way to fight tge E.
