    Font - In 2020, I recieved a notice of lien on my home. So did all of the neighbors I polled. All 9 immediate neighbors I asked, except one. He just built his home and joined the board. He stated that in 2019 they voted the HOA into mandatory status. I showed him that my deed has no hoa on it and my closing paperwork shows a voluntary hoa. He's from California and said that he was unsure of the legal merit of their tactic since he's new here and to the board but as the new secretary he witnessed

    Font - They now have to rescind every document back to the originals from 1963 and start over under the official advice that it will NEVER be mandatory since it'll prove to be impossible.     Font - megabass713 I'm honestly surprised the neighborhood didn't run the old president out of the town, with allusions to a caldron of hot tar, and a large amount of feathers. Old prez pulled some crazy shady and illegal tactics, and put liens on dozens of homes. That alone calls for an a whooping.

There are no common areas to maintain or otherwise need the funds. They bled the account nearly dry by hiring an attorney to convert to mandatory status and filing leins. Then paid an attorney to review my assertion and to vacate the leins and refunding homeowners that demanded dues to be returned that were paid under false

    Font - BuzzyBrie 2 yr. ago CAM Glad you guys fought it! In Florida if you want to take a voluntary or civic association to a mandatory, you have to have 100% owner approval(HOA). Good job!

    Font - [deleted] 1 yr. ago yep. my parents were/are grandfathered in with no HOA in the subdivision as were a lot (if not all) of their neighborhood. the subdivision decided to start up the HOA again. the only neighborhood not under the HOA is my parents bc everyone refused. as a result, houses there tend to get sold after a bidding war, even though the houses are older (built in the 80's, cinder block, etc) bc...no HOA.

    Font - WBigly-Reddit I hear you. We have that here too. One jibe suggested the idea of getting a voting quorum together, voting themselves in, and then assessing those errant board members for improperly spending board resources. By-laws likely allow for that because the acts were not justified by the CC&Rs and cost the Association money it didn't need to spend.
