AITJ for calling the police when my brother broke into my backyard to use my pool

I bought a house six months ago. It has a pool. My brother has three young kids who are completely undisciplined.
  • 03
Last month he asked if they could come swim. I said no. I don't want to be responsible for watching other people's kids in water and his kids have destroyed things in my house before.
  • 04
He asked again. I said no again. Offered to have them over for dinner instead but no pool.
  • 05
He got upset but dropped it. Two weeks later I come home from work and my back gate is open.
  • 06
I walk back there and my brother, his wife, and all three kids are in my pool.
  • 07
They didn't ask. They didn't call. They climbed my fence and let themselves into my yard.
  • 08
I told them to leave. My brother said I'm being ridiculous and it's just family. His wife said the kids were so excited and I'm being selfish.
  • 09
I called the cops for trespassing. When the police showed up my brother tried to say I'd invited them and forgotten.
  • 10
I showed them my security camera footage of them climbing the gate. They got a trespassing warning.

No arrest but it's on record. Now my entire family is furious. My parents say I humiliated my brother over "kids wanting to swim" and that calling police on family is unforgivable.
  • 13
My sister says I could have just let them swim this once and avoided all the drama.
  • 14
My brother is telling everyone I'm on a power trip because I finally have something nice and want to lord it over people.
  • 15
I don't think I'm wrong but the backlash has been intense. AITJ?
  • 16
JosKarith NTJ. If you let them get away with it "just this once" you'd have set a precedent that they could use your pool whenever they liked. Now they know you don't mess about.

ToreenLyn You say no, they commit a criminal offense, and YOU'RE the bad guy? Your family sound pretty entitled. Edited to correct spelling

Chicago White Sox35 NTA. You said no. They came over while you were out. That's trespassing. If it was strangers in the pool, it would be the same thing. You'd better put a lock on the gate. And maybe no trespass signs.

Impressive-Union6961 Obviously NTJ. A lot of families would object to calling police on family/kids in the pool and brother can easily paint you as a bad guy, but that does not make you one. Not sure what's the logic about inviting them to a dinner when kids messed up your house but not to a pool, but that's your business what you feel comfortable with.

MermaidSusi A pool is a liability. We have one and there is extra insurance, plus locks and a fence for a good reason! We also have a motorized pool cover that can only be opened and closed by entering a code. You should look into investing in one!

kerrymti1 Did you not bring up the insurance issue? If something happened, heaven forbid, YOUR INSURANCE would be forced to pay and then they would drop you like a hot rock.

Upbeat Vanilla_7285 Your brother is awfully entitled. Just because you have a pool doesn't mean he has an open invitation. He asked and you said no and they broke in and used it anyway. I'd avoid any family get togethers with them.

Professional Menu5229 NTA, NTJ. You need the police response in case there's an accident and you get sued. Your brother was out of line.
  • 25
carmelfan NTA. You said no, so it was trespassing. Period.

DazzlingPotion "My brother is telling everyone I'm on a power trip because I finally have something nice and want to lord it over people." You're not lording over anything. He feels entitled to come in, take it over and he's butt hurt that you shut him down. You did the right thing. He didn't listen and broke into your property. If you had allowed this to stand then they'd be in your pool all the time.
